Rapist Sentenced to 7 Years State Prison

Tuolumne County District Attorney Cassandra Jenecke announced today that on May 6, 2025, the Honorable Judge Douglas C. Boyack sentenced 20-year-old Jared Dakota Guin to a total of 7 years in state prison.  His sentence comes after a jury found Mr. Guin guilty of multiple charges, including Forcible Rape, Attempted Forced Oral Copulation, and Assault by Means of Force Likely to Produce Great Bodily Injury. The defendant waived jury and the court found three circumstances in aggravation; that he engaged in violent conduct that indicates a serious danger to society, his prior sustained petitions in juvenile delinquency proceedings are numerous or are of increasing seriousness, and that his prior performance on probation was unsatisfactory.

The convictions arise out of an incident that took place on November 10, 2022, where the defendant took advantage of a recent acquaintance when she visited his home in Sonora.  The defendant first attacked her in his living room causing her to blackout for a time when she declined his request to have sex.  When she came to the defendant physically forced her into his bedroom where he attempted to force her to suck his penis before he raped her despite her repeated pleas for him to stop.

At the trial, two other survivors of the defendant also testified about the sexual assaults they had endured at the defendant’s hands that occurred when he was a juvenile.  The defendant had been placed on juvenile probation for one of those offenses.  The juvenile court had found true a violation of probation on November 9, 2022 and ordered him to serve 30 days of home detention on the electronic monitor at which time his probation would then be dismissed as unsuccessfully completed.

At sentencing, the survivor of the rape provided a compelling impact statement and the People argued for the maximum possible sentence of 10 years in state prison.  However, the Court found that his age weighed in favor of a lesser sentence.  Under California law, the defendant will be evaluated before his release from prison to determine whether he qualifies as a sexually violent predator pursuant to Welfare and Institutions Code section 6600 and if he does then he will be referred for the filing of a petition with the court seeking an indefinite commitment to a state hospital for treatment.
