[ARCHIVED] Felony Domestic Violence Case Sentenced today, December 30, 2013

Today, December 30, 2013, Tuolumne County Superior Court Judge James A. Boscoe sentenced Mildred Lopez-Alecio to five years in state prison. This sentence combines two separate cases wherein Ms. Lopez-Alecio inflicted violence on different individuals. Ms. Lopez-Alecio is facing deportation pending completion of her prison sentence as Immigrations and Customs Enforcement has placed a hold on her.

The first case occurred on August 14, 2012. Ms. Lopez-Alecio struck a man over the back of the head with a beer bottle causing a large laceration to his skull. She and the man had been intimately involved and had recently ended their relationship. On March 4, 2013, Ms. Lopez-Alecio entered a plea of guilty to the charge of Assault with a Deadly Weapon. Assistant District Attorney Laura L. Krieg argued for a lengthy sentence in county jail. The Court granted Ms. Lopez-Alecio probation and sentenced her to fifteen days incarceration followed by 45 days on electronic monitoring.

The second case occurred on August 5, 2013. Ms. Lopez-Alecio engaged in a verbal argument with her cohabitant and then struck him in the face with a solid metal coat hanger breaking one of his teeth and splitting his lip. This case proceeded to a jury trial and Ms. Lopez-Alecio was convicted of Corporal Injury to a Cohabitant. The jury further found her prior conviction true.

On December 23, 2013, the Court indicated a six year prison sentence for the August 5, 2013 case. The court however continued sentencing to today so that probation could issue a report that also factored in her violation of probation case. Today, the court announced that it was “changing its sentence” citing mitigating factors including the defendant’s lack of a significant criminal record. The Court then sentenced Ms. Lopez-Alecio to five years in state prison for both cases.

The cases were prosecuted by Assistant District Attorney Laura L. Krieg.
