Tuolumne County District Attorney’s Office announced today that on May 12, 2025, Brad Leon McIver of Jamestown was sentenced to 4 years state prison for driving under the influence of alcohol after a prior felony driving under the influence conviction. 
Mr. McIver was involved in a solo vehicle crash on April 28, 2024, where he drove off the roadway. At the time of the crash, he had a family member also in the vehicle. The defendant's blood alcohol level was 0.307 percent just under three hours after the crash had occurred. 
Mr. McIver had a prior conviction for felony driving under the influence with an enhancement for causing great bodily injury. That conviction occurred within the last 10 years, elevating the current DUI charge to a felony. The prior DUI also qualifies as a “Strike” under California’s three strikes law, due to the great bodily injury enhancement. 
Mr. McIver was facing 6 years in state prison, which was the recommendation by the People to the Court. The Honorable Laura Leslie Krieg sentenced the defendant to 4 years state prison. At the time of sentencing, Mr. McIver indicated he did not know a subsequent DUI would be a felony, and that he never attended the mandatory DUI program. 
This case was prosecuted by Deputy District Attorney Kate Christie, the attorney assigned to the DUI Prosecution Unit. The DUI Prosecution Unit is funded by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.
