On April 27, 2021, the Fifth District Court of Appeals overturned the first-degree murder and kidnapping convictions of Elton Redick for his killing of Marc Dejong and his kidnapping of Bonnie Palmer. The Tuolumne County District Attorney’s Office was informed of the Court’s decision today by the California Attorney General’s Office.
The Court held the trial court erred by admitting Redick’s confession at trial and found investigators had violated his Miranda rights. Neither the AG’s Office nor the Tuolumne County District Attorney’s Office will be seek further review of the Fifth District’s ruling.
As a result of this finding, Redick will return to Tuolumne County for re-trial. The District Attorney’s Office will have sixty days to bring Redick to trial upon his return if he does not waive his speedy trial rights.
District Attorney Cassandra Jenecke states, “We will continue seeking justice for Marc Dejong, his family, and Bonnie Palmer by retrying this case and holding Elton Redick accountable for his actions.”
